1. Acceptance of Terms

By accessing or registering on BITFLIX ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform. Your continued use of the Platform constitutes acceptance of any updates to these terms.

2. Membership

BITFLIX is operated by BlyssDAO, a Private Membership Association (PMA). By registering, you become a member of this association. Membership is voluntary and governed by the principles of private association under common law.

As a member, you acknowledge that your relationship with the Platform is one of mutual membership and co-creation, not a traditional commercial customer-vendor arrangement. Members participate in and contribute to the ecosystem as co-creators.

3. Account Responsibilities

  • You must provide accurate and complete information when registering.
  • You are responsible for maintaining the security of your password and account credentials.
  • You must verify your email address to access full Platform features.
  • You must not share your account credentials with others or allow unauthorized access.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 13 years old to create an account.

4. Content Ownership

Creators retain ownership of their original prompts, creative direction, and any original material they upload to the Platform. AI-generated content produced on the Platform is considered a collaborative work between the creator and the AI tools used in its production.

By uploading or creating content on the Platform, you grant BITFLIX a non-exclusive, worldwide license to display, distribute, and promote your content within the Platform ecosystem. This license exists solely to operate and improve the Platform and does not transfer ownership of your work.

5. AI-Generated Content Disclosure

BITFLIX is an AI-powered filmmaking platform. All content created using the Platform's tools involves artificial intelligence in some capacity — including script generation, image creation, video synthesis, voice generation, and music composition.

The Platform maintains full transparency about AI involvement in content creation. AI outputs may vary and are not guaranteed to be factually accurate. Members are responsible for reviewing and verifying AI-generated content before publishing or sharing.

6. Acceptable Use

You agree not to use the Platform to:

  • Create, upload, or distribute content that promotes hate speech, violence, or discrimination.
  • Produce or share illegal content, including content that exploits or harms minors.
  • Impersonate other individuals, creators, or organizations.
  • Infringe upon the copyrights, trademarks, or intellectual property of others.
  • Attempt to reverse-engineer, exploit, or compromise Platform security.
  • Use automated systems (bots, scrapers) to access the Platform without authorization.
  • Harass, threaten, or intimidate other members.
  • Distribute spam, phishing attempts, or malicious software.

7. Content Moderation

BITFLIX reserves the right to review, flag, and remove content that violates these Terms of Service or the Platform's community guidelines. The Platform employs both automated and human review processes.

Members may report content they believe violates Platform policies using the flagging system. Repeated violations may result in account suspension or termination. Decisions regarding content removal are made at the Platform's discretion, and members will be notified when action is taken against their content.

8. Festival Submissions

By submitting content to BITFLIX festivals or competitions, creators grant the Platform the right to display, stream, and promote the submitted work within the context of the festival and related promotional materials.

Festival submissions remain the intellectual property of the creator. The Platform's display rights are limited to the festival context and associated marketing. Creators will be credited for their work in all festival presentations.

9. Creator Responsibilities

  • Creators must disclose AI involvement when sharing Platform-generated content on external channels or platforms.
  • Creators are responsible for ensuring their prompts and uploads do not infringe on third-party rights.
  • Creators should not present AI-generated content as entirely human-created when distributing outside the Platform.
  • Creators must comply with applicable laws in their jurisdiction regarding AI-generated content.

10. Privacy

Your privacy matters to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data. The Privacy Policy is incorporated into these Terms of Service by reference.

11. Sacred Reciprocity

BITFLIX operates under a Sacred Reciprocity covenant. 11% of all platform contributions are directed to the Four Worlds Jaguar Alliance, supporting indigenous partner communities and cultural preservation.

This commitment is a core value of the Platform and is not optional. By participating in the Platform, members acknowledge and support this covenant as an integral part of the BITFLIX ecosystem.

12. Limitation of Liability

The Platform is provided "as is" during its beta period, without warranties of any kind, express or implied. BITFLIX and BlyssDAO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

This includes, but is not limited to, loss of data, loss of content, service interruptions, or any damages resulting from AI-generated outputs. Members use AI-generated content at their own discretion and risk.

13. Changes to Terms

BITFLIX reserves the right to modify these Terms of Service at any time. Members will be notified of material changes via email or prominent Platform notification. Continued use of the Platform after changes are posted constitutes acceptance of the updated terms. We encourage members to review these terms periodically.

14. Governing Law

These Terms of Service are governed by the principles applicable to Private Membership Associations under common law. BlyssDAO operates as a PMA, and disputes between members and the Platform shall be resolved through mediation within the association framework before any external legal proceedings.
